DETROIT, Mich. – A federal judge in Detroit is scheduled to hear arguments Thursday, that could overturn Michigan’s ban on same-sex marriage.

According to the Detroit Free Press, it began as a case of child custody, where a same-sex couple wanted to unite their families with adopted children, but Michigan law prohibits joint custody among unmarried couples.

A lawyer representing the couple plans to argue that the ban violates their constitutional rights.

A ruling against Michigan’s ban on same-sex marriage would undo the vote of Michigan residents.

A spokesperson for attorney general Bill Schuette says he will defend the current law.
