COMSTOCK PARK, Mich. –The Kent County Prosecutor’s Office issued a warrant for 17-Year-Old Benjamin Malachino for one count of Threats of Terrorism, which is a 20 year felony. According to the Kent County Sheriff’s Department Malachino, a student at Comstock Park High School, sent threats to a female student that he was going to sexually assault her and also intended to lock down the high school and kill several students. Malachino included in his text message the names of three students (two from Comstock Park High School and one from Kenowa Hills High School) that he intended to kill.
Malachino was arraigned Monday in the 63rd District Court and is currently lodged at the Kent County Correctional Facility on a $500,000 bond.

Hell no am I going to leave him or this issue alone !! I could care less if he needs help, he needs to be removed from the school that MY kids attend !! He is a threat to MY kids when they are at this school on a daily basis. How can you possibly say, "leave him alone, he meant no harm, he is young and for all you know insecure"????? He is a student at a school with hundreds of other students that are his age or younger and he is threatening to KILL STUDENTS !!! For God sakes what the hell is wrong with you ??? I am glad they caught him before he could injury any students at the school. I hope he never has the opportunity to harm anyone and does get the help he needs, but don't say that FOX is just gossiping, they are letting parents know what is going on and the truth behind it. As a parent, I only received a very vague letter today about the incident and have been considered for my child's safety ever since. I am glad that FOX was able to inform me about the details. i go to comstock park and even if it was gossip he should not have said what he said. It is a scary feeling that he could have came to school and did that if he was not turned in. We do not need another school shooting and this arrest may have prevented it.

Wow. You say he meant no harm, but a threat to rape or KILL people is pretty flipping serious! He is 17 and almost old enough to be considered a legal adult. You don't just go around saying you are going to rape and kill people. I bet you would've had a different outlook on it if he actually did lock down the school and kill students. This guy needs help! Glad they caught him before he acted upon his thoughts!!!

I just want to say that I can completely understand all of your fears. It's scary. In all seriousness, however, there are almost no facts given in this article. There is no way to know anything about this young, and I'm sure terrified, boy or anthing else about the situation. Try to understand what he might be going through: a mistake with much more serious consequences than he ever considered. Try to understand what his family is going through. The people that watched him grow up and grew up with him are suffering and don't need uninformed or misinformed people crying out for "justice" when there simply aren't facts available. Please just take a step back and don't fuel the fire with unnecessary gossip.

Put yourself in the shoes of a parent or your parent for that matter. How would you feel knowing there was a student that had a issue with another student at your child's high school, that was severe enough that it caused him to want to KILL other students. He may have just wrote this threat out on a text msg, but the thought was still in his mind, he still was considering harming other people, which he had no right to do. If your child or yourself, were one of the students that this student had on his list of students he wanted dead or at least hated enough to want to cause harm to, would you want to give him a "second chance"? Now fast forward some years and he didn't get caught up in this in high school, he is now an adult and in an argument with someone and pulls out a gun and shoots them because of his temperment and he didn't get the help he didn't earlier in life. That person was your family member or your child, does he deserve a "second chance"? The kids that shot up high schools were misunderstood and did quite a bit of harm to people, do they deserve a second chance ? Not in my book they don't.

This kid is no terrorist. Acts of terrorism have governments as their targets.
Based solely on the article, he may have threatened to rape and kill people. As wrong as this may be he wasn't trying to take down the government.
The common law and Michigan Law have long held that while the words are offensive they have been historically treated as the lowest level of assault.
There is a law that specifically addresses what this guy did if we believe the article. It is MCL750.540e. It is a 6 month misdemeanor.
Unless there is more to this case than what FOX17 is reporting it appears as though this is prosecutorial overreach.

This is a prime example of what being bullied does to you. I graduated from comstock park last year and i witness kids harass him over and over again because he was a little outside the box. It's sad to only see one side of this as i was witness to numerous CP Kids harassing him so bad. I hope his story will be told fairly and he has a right to explain why he threatened what he did. This should be a lesson for those punk ass kids to stop harassing.
