Shaneka TorresKENT COUNTY, Mich. — The woman who was convicted of shooting at a McDonald’s drive-thru window after her burger didn’t have bacon on it is requesting a new trial.

Shaneka Torres and her attorney are set to appear in Kent County 17th Circuit Court at 1:30 p.m. Friday, according to officials with Judge Paul Sullivan’s office.

Officials at Judge Sullivan’s office said Torres is requesting a new trial due to statements that the prosecution made during closing arguments regarding her decision not to testify.

Torres was found guilty March 25 of carrying a concealed weapon, intentionally discharging a weapon and a felony firearms charge.    She was sentenced in April to between three and seven years behind bars.

On the morning of Feb. 10, 2014, she was a passenger in a vehicle that went through a McDonald’s drive-thru near 28th Street and Madison SE.   She ordered a burger with bacon, but when she received her order it didn’t have bacon on it.

Officials say she then shot at the drive-thru window.   No one was injured.

The defense argued that Torres fired her gun on accident.
