Prosecutor Sues City For Decriminalizing Marijuana

GRAND RAPIDS, Mich – The Kent County Prosecutor has filed a lawsuit in the Kent County Circuit Court challenging the legality of a marijuana amendment voted on by city residents. Residents voted to decriminalize marijuana by over 58% majority on November 6, 2012.

The city charter amendment made possessing the drug a civil infraction and prohibited police officers from reporting state law violations to the Kent County Prosecutor. The city was ready to implement the amendment on December 6, 2012.

Monday the court entered a temporary restraining order against the city preventing it from going ahead with its plan.

A preliminary injunction hearing is scheduled for January 9 ,2013 at 2:30 p.m.

According to the city, Grand Rapids will comply with the court’s ruling and will not implement the amendment until further order of the court.
