Court of Appeals hears Baby Kate murder charge dispute

LANSING, Mich. – The Michigan Court of Appeals has been listening to arguments this week from Sean Phillips, accused of killing his daughter, Baby Kate.

Katherine Phillips was four months old when she disappeared in Mason County in June of 2011.  Her body was never found, but Sean Phillips is serving a 10- to 15-year sentence for unlawful imprisonment in connection with the child’s disappearance.  He is now facing charges in her murder.

Phillips appeal was based on the fact the Baby Kate’s body has not been found, so there shouldn’t be a murder charge.

The court is expected to make their decision in coming days.
