KALAMAZOO, Mich. — The lawsuit filed against the Michigan Department of Corrections because an Ionia County facility ran out of waffles has been dismissed.

A federal judge has dismissed the lawsuit by Iatonda Taylor, who was angered when peanut butter and jelly sandwiches were served after breakfast waffles ran out at the Bellamy Creek Correctional Facility.  The lawsuit also complained that prisoners were served left over peach cobbler instead of bread pudding.

The lawsuit said the changes put the facility at risk for a riot.

U.S. District Judge Paul Maloney in Kalamazoo said Taylor didn’t show his constitutional rights were violated.

Taylor was convicted in the 2006 stabbing death of his brother in Grand Rapids. He is serving a life term.
