CHIPPEWA FALLS, Wis. – A 10-year-old girl has been charged after she allegedly stomped on the head of a 6-month-old boy at a Wisconsin day care, killing him.

The girl, who was charged with first-degree intentional homicide, appeared in court Monday morning.

According to the Star Tribune, the sobbing 10-year-old’s mother held her as the judge explained the charge before ordering a $50,000 cash bond.

The sheriff’s department received a 911 call October 30 from the caretaker of a licensed day care in the Town of Wheaton who said a boy was bleeding from the head and wasn’t responding, according to Chippewa County Sheriff Jim Kowalczyk.

“Later that afternoon, the sheriff’s department received a call from medical personnel, a doctor, attending this youth and his belief was that the injuries sustained by the 6-month-old boy were not an accident,” Kowalczyk said.

The boy was rushed to a hospital in St. Paul, Minnesota but didn’t survive. He was pronounced dead Nov. 1, according to the Tribune.

District Attorney Wade Newell said the girl later confessed to hurting the boy, according to WEAU.

“She stated she was holding the child and that’s when she dropped the child,” Wade said. “The child hit its head on the footstool and then the child started crying and she panicked and didn’t know what to do and didn’t want to get into trouble and then she proceeded to stomp on the 6 month-old’s head.”

While she appeared with her biological parents in court, the Tribune reports that she was with her foster parents, who operate the day care, at the time of the incident. Authorities had removed her from the custody of her biological parents in September.

OK.. this is a daycare. Where were the adults and why was a 10 year left alone with a 6 month old unsupervised. Sound to me like the providers should have been charged with neglect Child neglect is a form of abuse which is unfortunately prevalent in daycare centers. Simply put, day care neglect refers to the mistreatment of a child or a deficit in meeting his or her daily needs such as providing healthcare, supervision, nutrition, or other needs

*Questions for the self rightous Judge & Jury commentor: How do you know that the daycare provider didn’t briefly go into the kitchen to get a bottle for the baby? In your opinion is a daycare provider allowed to go to the bathroom to relieve herself? Did you keep your eyes on your baby 24 hours 7 days a week. If you did I guess your house must have been a mess.

The 10 year old was in Foster Care. We don’t know what type of problems she may have. She was taken out of her biological parents home only a month ago. She surely is going through emotional problems, depression, etc. We don’t know. She may have been severely punished for wrong-doing by her parents. This may be why she may have panicked when the baby started crying. (I knew someone who felt that if a child had no reason to cry – you should hit them to give them a reason. [Abuse to the max! Yes!]) But it happens. Can you imagine being taught this?

My question is, “Why was the 10 year old working in a licensed day care?” She should have been taken care of, after the trauma of being taken out of her own home. If help was needed, she could have been setting the table, folding laundry, etc. There are rules as to how many children per care taker in any day care. Also, no time was given. Shouldn’t the 10 year old have been in school? Of course, the 10 year old may have been unruly at home and that is why she was taken from the home. In that case, she should not have been placed around other children.
Fault could be blamed on her biological parents, the Day Care Home, or even Human Services (for placing the 10 year old in this home).

We don’t know the answers to many questions. I just hope the Judge, District Attorney, Psychiatrist,Investigators, and Jury (if it goes that way) do their job to the best of their ability in this case.

This is awful, it doesnt make total sense either, for a ten year old to ‘ stomp” a six month old to death, where were the ‘ foster parents’? This ten year old had to be exstremely stressed from seperation, watching a baby? How many other children? There is way more and sad example of Seperating child from family. Sad sad sad.
