(WXYZ) — The University of Michigan is asking a federal court to dismisses the case brought against the school by a former student who says he was abused by Dr. Robert Anderson.
The motion filed with the US District Court for the Eastern District of Michigan contends the suit was filed decades after the statue of limitations had expired. It also contends that under the doctrine of sovereign immunity bars all of the Plaintiff's claims, expect those that were brought under Title IX.
The university also argues that, if the case does proceed, the University of Michigan should be dismissed as an improper defendant, because the Regents of the University of Michigan are the organization which should be the subject of the lawsuit.
