Man Fined For Taking Dead Deer From Road

Gary Austin of Fennville says it all started with a call that someone had hit a deer. He wanted to give the animal to a family that needed some help, so he took the deer to the police department to get it tagged.

“I was just going to surprise them and I thought it would have been a really nice surprise. A big chunk of meat coming your way, it makes you feel good when someone thinks about you,” Austin said.

He had no idea that he was actually breaking a law. Gary says the man who hit the deer, didn`t call to report the accident.

“I didn’t know. I tried to be as honest as I could and I said that’s why I took the deer to the police department,” Austin said.

According to officials with the DNR, the person that hit the deer should have called and reported the accident. The responding officer could have issue him a permit to take the deer, as long as they believe the deer died following a car accident, and wasn`t poached.

“He said he was going to take it and scan it. I said fine, I don`t have a problem with that. I said all I was going to do with the deer was get it tagged and pass the meat on to someone who could really use it,” Austin said.

Gary says he was going to take the deer and give it to a family that need some help.

“It feels like you take one step forward and three steps back. It`s always about how we should be taking care of each other. We should be paying it forward. Why leave an animal on the side of the road that`s just going to rot, when that would be a meal for somebody,” Austin said.

Gary was issued a ticket for $190 for possession of road kill deer without a permit. He plans on fighting that ticket.

    WT Heck…….a man trying to pay it forward gets a ticket even though he tried doing the right thing and get a road kill permit…what is the word coming to?

    That’s truly a shame he was ticketed. This man did the right thing by bringing the animal in to the police department to ensure he was doing everything the correct way and then was punished for it? Come on! That’s just crazy and wrong! That animal would have went to waste rotting there when a family could of really used the meat. I would definitely fight this ticket! I think u did the right thing and commend u for it!

    *hand to forehead* I have known people who have been told by the DNR or police officers, just pull the animal off the side of the road till road commission picks it up. So I comend gary for trying to pay it forward. Fight the ticket! DNR wanting to make sure it was hit and not poched, wow…

    My dad has never gotten a ticket in his life and to get one over this is sad and pathetic. He was done nothing wrong and is doing right by fighting this. He was only doing what any reasonable person would, helping supply already dead food to a family in need. I will give him my full support and am proud that he is fighting for what is just. That DNR was way out of line, he needs to realize his mistake and own up for it before things get to out of hand.thank you to everyone who is lending their support in my fathers fight.

    MDNR Law Enforcement Officers (Bush Pigs) live by the letter of the law. Don't lean a loaded shot gun against your truck when coming in from the field. Seen it happen on State Land during deer season and two legally licensed hunters along with their teenaged sons got hemmed up in some B.S. for taking an innocent lunch break from hunting.

      I could see if people were actually doing something wrong but the DNR do what they do because the can and there is nothing you can do about it. Its a shame that we as people cant do something about things like this. This is one reason I will be in court supporting Gary.

        Its not like he will be taking the day off work or any thing! he would have to have a job to do that. I dont have to go to court to show my support. I just get up and go to work and paytaxes to support him. No need to go to court!

He has several small fractures in his back as well. So yeah he doesnt work. But he worked for many years so it really shows what you know. You can keep bashing him all you want. Because it still does not take away the fact that he was trying to help a family in need.

    Its become a world of money and material things and the me me me generation, And when people want to help each other, they are punished, absolutely ridiculous! I am thinking about moving to some island, I really have become dissappointed in our society, sorry to say. And trying to teach your kids to do the right thing, how are we supposed to do that, with stories like this.

    Issuing a ticket to Mr. Austin under the circumstances is in itself Nothing Short of Criminal.
    Law without Grace Never Services Justice especially in Mr. Austin's situation, it only serves the writ of the law itself and that Not Why We Have Laws. They are written to preserve the peace and well being of tthe citizens, Maybe I'm wrong but it seems to meet that would include compassion and maybe a little bit
    of common sence. To the member of the DNR who issued this ticket to Mr. Austin your either really obtuse or just plain heartless. You should reconsider or at the least be sorely ashamed of Yourself!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!

      I think the DNR did the right thing, other that they should have tasered his ass for no more than an hour. I say no more than an hour because any thing over and hour could be considered cruel and unusual. They could have gotten away with a couple of cracks across that big melon of his. It would have made him look more sympathetic on TV with a black eye, bit of swelling. Maybe even shed a few tears. Yeah that’s the ticket!

          Will, my friend you are funny, had to laugh but you made my day….lol…..yeah some people just dont get it. Maybe he broke the law by picking up the deer but he took it to the police station to get a permit. As some have stated the deer would have just laid there and rotted anyway so why not let him take it to a family that could have used the meat.

    It took more effort to whine to the news than it would have taken to legally possess that deer. Next time do it right like everyone else. Maybe FOX17 should run a report reminding people of the law and the basis for it rather than this one sided piece of drivel. What's next "Local Woman Receives Parking Ticket"?

      First of all Ann, not all people know ALL the laws….if he was trying to do something illegal he would not have taken the deer to the police! Second, if he didnt have his phone to call the police and no one was stopping to help where do you suppose he would have made this call from, A TREE PHONE! The DNR officer has every right to get on here and tell his side so that is up to that officer. I hope that you never find yourself in a bad situation. But if you do, lets hope you dont get the kind of response that you gave. You sound as heartless as that DNR officer was. He took the deer to the police to obtain a tag to give it to a needy family. Maybe if there was more people like him out here the world would be a better place.

The guy obviously wasnt trying to steal the deer because if he was he would not have taken it to the police station….seriously…lol. Who cares if you know him or not.     To the ignorant people that even after reading what happen think that he was TRYING to GET AWAY with ILLEGALLY obtaining road kill deer.. Know the facts before you spout out “Drivel”.

    He did NOT HAVE A CELL PHONE. Do he could WAS NOT ABLE TO CALL. The police station was only a couple of miles away.

    HE TOOK THE DEER TO THE POLICE TO GET IT TAGGED!!

    Apparently there is a new law that the DNR also has to be notified. Which I did not know of this either!

    I have hit a deer in the past & DNR didn’t have to be notified, or involved!

    The DNR Officer that came out should NOT have given him a ticket. Gary was trying to do a good thing, and trying to do it legally by taking it to the police to get it tagged.

    The most that DNR Officer should have done is maybe gave him a talking to, educate him on the new law, and told him to not let it happen again!

I have known Gary for most of his life. He has NEVER and I do mean NEVER paid anything forward always stops with him. But I’m sure that he was clueless that it was against the law. But being ignorant of the law is a very poor defense as Gary should know this all too well, This isn't his first rodeo as far as the law goes. And all these family members posting here know that. Thin some of us that have been supporting him with our tax $$ can get a small amount of money back.         OK, sweetheart I will try to explain it to you. (I will type slowly so you can understand it.) See if someone does not work (could work but will not) in this case less say GARY and receives a check from the government (taxpayers) see he did not earn. We the public are paying the 200.00 ticket. Now it is good to know that some of the money is going back to the DNR (Good job DNR). And as far as him being a giving guy B.S. you are his sister sure you’re going to defend him (and that’s nice of you, a good sis). But that don’t change the truth.

          Well sweetheart, let me explain this slowly to you….Gary has worked and did it for many many years. With fractures in your neck and back i would think it would be very hard to work…but i guess people get surgeries for nothing and doctors do it for no reason….lol….but its ok, i work and if thats where my tax dollars are going then i am fine with that. Because i would rather know its going to someone like him then someone that gets it because they are an alcoholic, or drug addict.

    What a bunch of bull! The road commmision doesn’t do jack when it comes to roadkill. Just earlier this summer I was with a friend and we saw a deer after it had been hit by a vehicle, as both of it’s hind legs were obviously broken. We called the PD to report it and they said the’d pass the info on…for the rest of that day as we passed the injured animal, we saw as it tried uneffectively to run away. the fact that they let that animal suffer, really irked me! That deer could’ve fed a few families and the maan who tried to do the right thing gets a ticket?! Just goes to show the pure greediness of govt & state agencies…smdh!
