Toy Gun Leads To Standoff

Reports of a man armed with a handgun caused a standoff to last several hours in Muskegon early Monday, police unaware the weapon was actually a toy.

The suspect was identified as Robert James Brooks, 39, who allegedly assaulted a woman inside a residence where the standoff occurred.

Muskegon County Prosecutor-elect D.J. Hilson said Brooks won’t be charged with a weapons offense because Brooks allegedly wasn’t carrying a real weapon inside the woman’s home in the 2300 block of West Sherman Boulevard.

Brooks has a previous criminal history, is being charged with obstruction of justice, resisting and obstructing officers and as an habitual offender.

According to the prosecutor-elect Brooks is expected to be arraigned Wednesday.

Muskegon police was dispatched to a home on Sherman Boulevard around 2:30 a.m. Monday morning, after a 9-1-1- call stated a woman inside the house was being assaulted by an armed man.

According to the county prosecutor’s office, a 2-year-old boy also was in the home at the time.

    Bothers me that this man will not be charged with a weapons crime due to the fact that it was not a real weapon! Because of the nature of this crime I feel that this man should be charged with a weapons crime because rather its a toy or a real gun his intent was the same!
