Michigan Man Charged With Felony After Exceeding Public Comment Time Limit

BRIDGEPORT TWP, Mich. (March 18, 2014)– A man in Saginaw County is facing a felony charge after being arrested at a township board meeting March 4, for going over his allotted speaking time.

Mark Adams was charged Friday, March 14 with a felony resisting and obstructing police and a disturbing the peace misdemeanor.

The incident was caught on camera and has been viewed thousands of times.

FOX 17 spoke exclusively with the man arrested, traveling across the state to get answers.

Adams was pulled from the podium by several officers and arrested after exceeding the public comment time limit of three minutes, addressing several issues he has with his local government.

Township supervisor Augie Tausend asked Adams to summarize his comments after four minutes and to sit down several times.

Tausend says it’s not the first time they’ve had issues with Adams, saying they’ve asked him to sit down at meetings before, but this time was different.

Adams says the arrest was pre-planned.  Tausend denies that, saying two new officers were at the meeting being sworn in and the others were there to watch.

Though public comment guidelines are clearly laid out and posted on the building where the meeting was held, Adams says his rights were violated.

“Freedom of speech doesn’t have a time limitation, there’s no time limitation when you talk about our constitutional freedoms,” he said.

      Congress does it all the time under quorum rules and I assume this cityhall meeting falls under parliamentary debate rules……….They could have given him additional minutes easily.

    This is BULLSHIT, what is this world coming to. When they want to talk, they have all the time they want, but when an individual wants to ask questions it seems as if they just don't want to take the time to listen. Anybody in their right mind can obviously see there is no resisting, and uncalled for force from a public official is totally out of our constitutional rights. It sure makes the police dept look like shit, and our city officials look like assholes. Like I said, " WHAT THE FUCK IS THIS WORLD COMING TO !!!! "

    Since he was speaking about constitutional rights when he was arrested, its clear what party the township officials belong to…

    All across the nation free speech is being muted, a law was even passed that allows protestors to be arrested for protesting to close to the president

    During meetings 3 minutes if time can be given to someone who wants to speak at meetings. When someone is placed in the agenda to speak about items the 3 minutes might be used and might not be used if the subject matter is of political interest to the board . Some speakers might be granted without question even an hour with no questions asked . With review of recent tapes or prior meetings and pure descrimination and bias can be seen. Then the 3 minute law has no power since it has not been protected in itself by protection if use in fairness. We have a type of “The Gong Show.” What is ba about placing a person on the agenda to speak sets all agenda line items as discussion items with unlimited time, unless all agenda items are given equal 3 minutes. Was “the michigan man ” placed in the agenda to speak or just “open invitation “? During prior meetings have others of interest been given more than 3 minutes with no questions asked and no arrest?

    3 minutes is the normal allotted time for speaking during the public comments section on a township meeting agenda. If you want to speak with a township board rather than to them get scheduled on the agenda. Also, the public comment time isn't for interaction with the board, nor is it intended for the public to filibuster the board meeting. A township board meeting is the allotted time for the township board to conduct the township's business for that month, i.e. pay the township's bills for that month and to deal with items that are on the agenda. The felony charges are because he allegedly resisted arrest. When the police tell you are under arrest follow their instructions to the letter and you won't have resisting arrest charges.

        I don't like to tell people how to live. I don't live in Bridgeport township. I do have to wonder how many people commenting here have been to a township meeting or served on a township board.

    This make it look like the Board members and the Police are dirty… in this town. Need to do full investigation on all of them… Call in the FBI… Plus this guy should sue the Police and the Township for violation of his rights…

    it's just wrong. you pay taxes, part of that goes to the townships. the townships use that money to tell you what to do and hire attorneys to fight against u. they will impose fines and add them to your taxes if you do not comply with their orders. if you can't afford your taxes they take your land from you in a tax sale. and you have to come up with more money to defend yourself.

    I am sure there is a good lawyer out there who would be happy to take this case pro-bono and mop the floor with careers of those involved. Please look into it.

    Seems that town board is very famiar with this liberal anti government. He was asked several times to end his comment and then became disorderly. the police were doing what they were told to do. Everything always has to turn into a cop bashing session for people with no balls to be disrespectful towards the police on the web.
